PROGRAM

I. From Hard Drive to Jury Room:  21st Century Foundations for Social Media and Other Digital Evidence

Increasingly, the outcome of civil and criminal trials turns on digital evidence. Whether e-mail, text messages, social media postings, or website content, “digital evidence” can be the most persuasive evidence in a case, particularly when issues of intent, motive, state of mind, or physical and mental condition are involved.  Trial lawyers in the 21st Century need to be ready to deal with evidence of this kind in their courtroom presentations today.  This session will give you the tools for doing so.

II. Computer Graphic Evidence:  When to use it, and how to get it in front of the jury.

Georgia Staton has more than 45 years of experience representing governmental entities, including state, counties and cities, as well as school districts and privately-held corporations. She is committed to defending clients on issues involving governmental liability, employment law, personal injury and civil rights. Georgia has tried more than 75 cases to verdict in state and federal court in matters involving wrongful death and claims brought under the Americans with Disabilities Act, Family and Medical Leave Act, Title VII discrimination and sexual harassment claims and retaliation, as well as false arrest and excessive force allegations against law enforcement including pursuit cases and SWAT actions.  Georgia is a Certified Specialist in Personal Injury and Wrongful Death. She currently serves as co-chair of the Governmental Liability Employment Trial Group.

Paul McGoldrick's extensive trial experience, evidenced by his election as a Fellow of the American College of Trial Lawyers, provides a solid foundation for effectiveness in litigating and mediating a wide variety of civil disputes.

Paul McGoldrick chairs the firm’s litigation practice group along with Tom Shorall. Paul focuses his litigation practice on personal injury cases and has experience as lead counsel in complex business disputes. Paul routinely represents clients in nearly every locale of Arizona and has represented both plaintiffs and defendants, both in tort cases and in the context of commercial and professional liability suits.

In addition, Paul is a frequent mediator and arbitrator, helping to provide effective alternative dispute solutions to other attorneys and their clients. He is a member of the prestigious National Academy of Distinguished Neutrals.

The American Board of Trial Advocates has elected Paul a member based upon his many jury trials and peer review. More recently, Paul has been elected as a Fellow of the American College of Trial Lawyers. Paul draws upon his broad experience as a trial lawyer in helping to reach resolutions to lawsuits short of more expensive jury trials.

Before entering private practice in Phoenix, Paul was a law clerk to the Honorable Frank X. Gordon, the then-Vice Chief Justice of the Supreme Court of Arizona. Since 1997 he has been a Certified Specialist in Injury and Wrongful Death Litigation.

Hon. Katherine (Kay) M. Cooper was appointed to the Maricopa County Superior Court in 2011 by Gov. Brewer.  She is currently assigned to Family Court, Downtown.

Trial Work

Randy has an active trial and arbitration practice and has successfully tried cases ranging from his defense of a man accused of first-degree murder to a complex lease and regulatory dispute that resulted in an $11.2 million jury verdict for the firm’s client. He also regularly arbitrates cases and has obtained several awards exceeding $1 million in arbitrations and several defense verdicts in the same area arising out of partnership and corporate disputes. He was part of the trial team that in 2016 obtained a nationally publicized jury verdict that the writer, director, and producer of the Broadway play, Jersey Boys, copied from an unpublished manuscript of a deceased lawyer. In 2011, Randy was invited into and inducted as a Fellow of the American College of Trial Lawyers, the preeminent trial lawyer organization in America.

Commercial Litigation

With a background in finance and economics, Randy has experience in handling a wide variety of commercial disputes. He has particular experience in disputes involving partnerships and other joint venture disputes, real estate, restrictive covenants, and intellectual property litigation. He was selected by Best Lawyers and his local peers as the 2013 Lawyer of the Year for “Bet-the-Company Litigation.”

Antitrust Disputes and Counseling

Randy counsels trade associations, industry consortiums, non-profits and corporations on antitrust, restrictive covenant and other unfair competition matters, and has served as counsel in several major antitrust class actions filed in Arizona. He is a past Chair of the Antitrust Section of the State Bar of Arizona.

Pro Bono

On a pro bono basis, Randy has handled three high-profile murder cases in which he believed the defendants had been falsely accused. In one, after a six-week trial, the jury hung 8-4 in favor of acquittal. In another, the State eventually dismissed all charges. In the third case in Qatar, Randy's clients were exonerated by the Qatari courts. Randy has received multiple awards for his pro bono and community service work.

Judge Dawn Bergin has an undergraduate degree in finance and studied graduate level international business relations on a Rotary Scholarship at the Autonomous University of Madrid for one year. After receiving her law degree from the University of Virginia, she began working at Lewis and Roca in Phoenix. She practiced complex commercial and tort litigation there for 12 years, both as an associate and a partner. She left Lewis and Roca for a year and a half to serve as Associate General Counsel for Rural/Metro Corporation. Judge McNamee received a Bachelor of Arts degree from the University of Cincinnati in 1964 and an Master of Arts from the University of Arizona in 1967. He received a Juris Doctor from the University of Arizona College of Law in 1969. He was an attorney in the Legal and Finance Department of the Florsheim Shoe Company from 1969 to 1971. He was an Assistant United States Attorney of the District of Arizona from 1971 to 1979. He was a Lecturer of the College of Business at the University of Arizona from 1975 to 1979. He was a First Assistant United States Attorney of District of Arizona in 1980. He was a Chief Assistant United States Attorney of District of Arizona from 1981 to 1985. He was the United States Attorney for the District of Arizona from 1985 to 1990.

McNamee was nominated by President George H. W. Bush on February 20, 1990, to a seat on the United States District Court for the District of Arizona vacated by Judge Charles Leach Hardy. He was confirmed by the United States Senate on May 11, 1990, and received his commission on June 4, 1990. He served as Chief Judge from 1999 to 2006. He assumed senior status on October 1, 2007.
