Trial Lawyers Want to Win At Trial – But At What Cost? 

This seminar will explore winning tactics at trial and also expose the audience to ethical and professional issues which will enhance your success with professional and ethical presentations. Listen to some of Arizona’s best trial lawyers and judges discuss what resonates with jurors and the court. Learn what you can and cannot argue and the ethical pitfalls to avoid.

SESSIONS

1.     Ethical Issues For Trial Lawyers And Avoidance of Bar Inquiries. All trials involve numerous judgment calls and the implementation of strategic decisions. This section will address the ethical issues involved in trial practice.  Presenters: Peter Akmajian, Michael O’Connor, Jeff Willis, Hon. James Teilborg.

2.    Developing a theme for both the plaintiff and defense. Successful lawyers develop a theme for their case and follow through from discovery/disclosure to trial. The presentation will also address use of jury consultants and thinking outside the box. Presenters: Tom Shorall,  Joseph Mais, Reid Garrey

3.    Jury Selection and  Opening Statements. This presentation will assist you in choosing your audience in voir dire.  You will also learn tips to effectively present your winning position in opening statement with emphasis on why your position is a winner. Presenters: Thom Slack, William Sandweg, Georgia Staton, Ted Schmidt, Hon. Kay Cooper.

4.    Expert Selection and Discovery. This presentation will focus on thought process of selecting an expert and on what issues; decisions on taking expert depositions or not; and how to effectively present experts at trial. Presenters: Tom Burke, Mick Rusing and Randy Papetti

5.    The Role and Interplay Between a Civil Trial With Parallel Criminal Issues. This presentation will focus on common issues trial lawyers face with criminal parallel proceedings. Issues to be discussed are how and when the Fifth Amendment can be invocated and its consequences, use of grand jury transcripts, the effect of a criminal plea on the civil case and what Fourth Amendment protections are available in civil trials. 6.    Professionalism In and Out of the Courtroom. This presentation will discuss professional issues which face all trial lawyers in the workup and presentation of the trial. Presenters: Hon. Timothy Thomason, Hon. Tom Zlaket, Lonnie Williams, Phil Gerard

7.     Mediation and Arbitration – Have These Replaced Traditional Jury Trials? This presentation will discuss the trend of alternative dispute resolution and how your ability to try a case impacts your ability to obtain favorable results at mediation. Presenters: Shawn Aikin, Burr Udall, Michael Murphy and Winn Sammons
